By subscribing to the Illawarra Mercury, you accept the following terms and conditions. For the avoidance of doubt, these Subscription Terms and Conditions relate only to Illawarra Mercury subscriptions pre-purchased through Fairfax. It is up to you to determine whether or not a subscription to the Illawarra Mercury will best meet your individual circumstances.

1. DELIVERY AREA
1.1 Subscriptions are valid in NSW where normal distribution of the Illawarra Mercury exists. For information on delivery outside of these areas, please call the Illawarra Mercury on 02 4221 2234. Delivery to addresses within security apartments or office buildings is subject to delivery capability. A Subscription may be discontinued with notice to You (with a pro-rata refund) where distribution services to Your address cease to be available for any reason whatsoever.
2. FEES AND CHARGES
2.1 Prices quoted for Subscriptions are in Australian dollars and are GST-inclusive.
2.2 Direct Debit Subscriptions:- deductions will be made from Your nominated bank account or credit card every 4 weeks in advance of Your newspaper delivery. A direct debit via credit card will incur a 1.5% surcharge. You acknowledge that subscription prices for direct debit subscriptions may be changed by Fairfax from time to time, by giving You at least 14 days' written notice. Price changes will take effect from Your next billing date after the notice period. If You do not wish to continue your Direct Debit Subscription at the revised price, You may cancel Your subscription by contacting the Illawarra Mercury 72 hours before the end of Your current direct debit pay cycle. The authority to debit Your account every 4 weeks remains valid until You notify the Illawarra Mercury that You wish to cancel Your Subscription by contacting the Illawarra Mercury on 02 4221 2234. IT IS YOUR RESPONSIBILITY TO NOTIFY US IF YOUR DIRECT DEBIT ACCOUNT IS CANCELLED OR IF YOUR ACCOUNT DETAILS CHANGE BEFORE YOUR NEXT BILLING DATE. If we are unable to debit Your account for any reason, we will notify You. Your subscription will continue during the notice period. You will generally be required to clear any unpaid subscription fees, and reimburse us for any transaction fees that we incur as a result of a failed direct debit transaction, as a condition of continuing your subscription. Direct Debit Subscriptions are not available for promotional subscription offers unless otherwise specified.
2.3 Upfront Subscriptions: the full, fixed term payment is due upfront and is payable by cheque, money order, cash, EFTPOS or credit card. Payment by credit card will incur a 1.5% surcharge. At the end of the Subscription term You may contact the Illawarra Mercury in order to renew Your Subscription. We reserve the right to change the duration of the Upfront Subscriptions and the pricing of Upfront Subscriptions offered from time to time. For the avoidance of doubt, the price of Your Upfront Subscription cannot be changed by us during the applicable term.
3. MANAGING SUBSCRIPTIONS
3.1 If at any point You wish to have your newspaper redirected to a new address within our home delivery area, or You wish to temporarily suspend your Subscription, You will need to contact the Illawarra Mercury on 02 4221 2234. Your Subscription delivery details can be changed by giving the Illawarra Mercury at least 3 business days' notice.
3.2 To suspend your Subscription, You will need to tell us the date that You want to suspend your Subscription from, and also the date that you would like your Subscription to restart. If you fail to provide a restart date, and fail to restart your subscription within 90 days following its suspension, we may cancel or restart your subscription with notice to you. You will be permitted to suspend your Subscription for a maximum period of 90 days on each occasion. The exact number of days that your Subscription is temporarily suspended will be credited to the end of your Subscription.
4. PROMOTIONS
4.1 Fairfax may at times offer special promotional offers. The specific terms and conditions of each promotion will be clearly stated at the time of the promotion and will apply in addition to these Home Delivery Subscription Terms and Conditions.
4.2 In the event of any inconsistency between the terms and conditions of a special offer and these Home Delivery Subscription Terms and Conditions, these Home Delivery Subscription Terms and Conditions will apply.
4.3 You may be required to provide your payment details when you sign up for a promotion. If this is a direct debit offer, your subscription will be automatically renewed after your initial payment at the standard subscription rate unless you cancel under the terms of the cancellation policy (see clause 5 below).
5. CANCELLATIONS
5.1 You must call Illawarra Mercury on 02 4221 2234 to cancel Your subscription.
5.2 Upfront Subscriptions: a cancellation fee may apply to Upfront Subscriptions cancelled prior to expiry of the applicable term. This is due to administration costs incurred in processing a cancellation. A pro-rata refund will be provided, less the cancellation fee imposed. A $25 cancellation fee may apply to weekend Subscribers. A $50 cancellation fee may apply to 6 day per week Subscribers. No refund is provided on Subscriptions cancelled within 2 months of the expiry date.
5.3 No refund is given to direct-debit Subscriptions. The Subscription will simply expire at the end of the four week period for which payment has already been debited.
5.4 In the event of a cancellation of Your Subscription by You or the Illawarra Mercury as a result of ongoing major delivery problems or non-delivery within your area (being NSW), no cancellation fee will apply and you will receive a pro-rata refund for the outstanding portion of the subscription.
5.5 A cancellation fee of $100 will be charged for early termination of any special promotional subscription campaigns.
5.6 We reserve the right to suspend or cancel Your subscription at any time in our absolute discretion. In the event that we cancel Your subscription, you will receive a pro-rata refund for the balance of the term on Your subscription.
6. PRIVACY
6.1 You agree that your personal information such as Your name, address, email address, year of birth, postcode, gender and telephone/mobile number and delivery information for the purposes of identification and account administration is collected and stored by Fairfax Media. Billing details may be captured for the purposes of the transaction by us or by our external service providers in places such as New Zealand, Singapore, the United States or the Philippines for the purposes of dealing with and/or fulfilling Your Subscription. Fairfax Media may also use your personal information to communicate with You about Your Subscription and to notify You of any associated Customer offers or benefits or future subscriptions, unless otherwise notified by You.
6.2 Information on how we handle your personal information is explained in our Privacy Policy Statement.
7. SUBSCRIBER LOYALTY PROGRAM – MERCURY REWARDS
7.1 6 day print or Digital Edition Subscribers automatically become Mercury Rewards Members with access to exclusive offers and benefits. These offers and benefits may change from time to time without notice. 8. WARRANTY AND DISCLAIMERS
8.1 You agree that any errors made in entering the contact information and subscription order details are Your responsibility and the Illawarra Mercury is not liable for any consequences that may arise as a result of such errors or incorrect information, including but not limited to sending the Subscription to the address as notified by You. If You change your address or any other relevant details or do not receive your Subscription, it is Your responsibility to notify the Illawarra Mercury by calling 02 4221 2234.
8.2 To the extent permitted by law, the Illawarra Mercury is not liable to You for any loss or damage incurred by You arising out of your Subscription, whether direct, consequential, special, indirect or other loss or damage. In any event, the Illawarra Mercury’s maximum liability to You is limited to the value of the Subscription fees paid within the previous twelve months.
9. GENERAL
9.1 You acknowledge and agree that You are entitled to purchase a Subscription from the Illawarra Mercury for personal use only. You agree and acknowledge that Subscriptions cannot be exploited for any commercial purpose, including on-selling Your Subscription to any third party. Despite this, Fairfax may, at its sole discretion, offer multiple copy subscriptions to certain organisations. Such corporate subscriptions can be arranged by contacting the Illawarra Mercury on 02 4221 2234.
9.2 You agree that all Subscriptions provided, benefits accepted or offers made by the Illawarra Mercury shall be deemed to be provided in Australia, notwithstanding your location, and the terms of such shall be governed exclusively by New South Wales law, and the Courts of New South Wales shall have exclusive jurisdiction to determine any such matters that may arise involving or alleged to involve the Illawarra Mercury.
9.3 You acknowledge that these Subscription Terms and Conditions may be modified by the Illawarra Mercury from time to time, and agree that You are responsible for regularly reviewing these Subscription Terms and Conditions, and You agree to any such modification.
9.4 From time to time the Illawarra Mercury offers promotional items with its newspapers. The Illawarra Mercury does not guarantee that newspapers delivered to Subscribers will include these items. From time to time, these items will be available for collection at a newsagency or the Illawarra Mercury offices. At its discretion the Illawarra Mercury will communicate with its subscribers about the availability of such items.
10. DEFINITIONS
In these terms and conditions:
10.1 ‘Illawarra Mercury’, ‘we’ or ‘us’ means Illawarra Newspaper Holdings Pty Ltd, publisher the Illawarra Mercury.
10.2 "Subscriber", "Customer" or "You" means a person who is a subscriber to the Illawarra Mercury.
10.3 A "Subscription" means a standard Illawarra Mercury subscription taken up directly with the Illawarra Mercury and for which these terms and conditions apply. A Subscription includes all parts and sections of the publication deemed part of the publication for home delivery; this may change from time to time in accordance with the Illawarra Mercury’s reasonable logistics and operational requirements. A Subscription may be made by direct debit which is an ongoing Subscription where the Illawarra Mercury debits the cost of the Subscription from your bank account every 4 weeks ("Direct Debit Subscription"), or a fixed term Subscription where the full payment is made by you upfront ("Upfront Subscription").
